Operating as a non-entrepreneurial tourist lease (locazione turistica non imprenditoriale), we have mandated Bed & Benacus Srl to manage all on-site operations, guest check-ins, and financial settlements. All invoices/receipts for your stay are issued by Bed & Benacus Srl acting as the authorized management partner. Responsibility for website content according to § 18 MStV: Andrey Semin.
Dispute Resolution:
The European Commission's Online Dispute Resolution (ODR) platform was discontinued on July 20, 2025. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board according to § 36 VSBG.

1. Introduction and Legal Framework
Welcome to Amore Garda. These Terms and Conditions govern the contractual relationship between the Host ("Lessor") and the Guest ("Lessee"). The apartments are privately owned by Andrey and Nadine Semin. The website is operated by Andrey Semin, a natural person resident in Germany. While the properties are privately owned, all day-to-day operations, guest reception, and financial transactions are managed by our authorized partner, Bed & Benacus Srl, located at Via Casello 18, 25019 Sirmione (BS), Italy ("Management").
2. Legal Nature of the Stay and Property Identification
Tourist Lease: In accordance with Art. 1571 et seq. of the Italian Civil Code and Art. 4 of Decree-Law 50/2017, this contract is classified exclusively as a "Tourist Lease" (Locazione Turistica) for residential use. We provide a residential apartment for temporary tourism purposes only; we do not provide hotel-style professional services such as breakfast or daily cleaning during the stay.
Registration: Our properties are officially registered with the Ministry of Tourism. Our National Identification Code (CIN) is displayed in the footer of this website and at the property as required by Art. 13-ter DL 145/2023. We adhere to all mandatory safety regulations, including the provision of fire extinguishers, carbon monoxide detectors, and gas sensors.
3. Booking and Confirmation Process
Reservations are facilitated through the Smoobu reservation system. By making a reservation, you enter into a direct rental agreement with the Owner, facilitated and managed by Bed & Benacus Srl.
After completing a booking on our website, you will receive a confirmation email from the email address: loading.... If you do not receive this email within 10 minutes, please check your spam folder and/or contact us using the methods listed in Section 15.
Direct Booking Rates: For reservations made directly through this website, the base rate may differ slightly from the rates listed on third-party platforms. Direct bookings do not include OTA commissions and may include flexible terms. All rates are clearly shown at the time of booking.
4. Financial Transactions, Payments, and Anti-Fraud Policy
To ensure security and prevent fraudulent activities, we maintain a strict electronic payment policy in accordance with Italian Anti-Money Laundering (AML) regulations (D.Lgs. 231/2007).
- Accepted Methods: For bookings made directly on this website, we only accept credit card payments processed securely through the Stripe gateway.
- Excluded Methods: We do not accept cash, personal or bank checks, direct bank/wire transfers (SEPA/SWIFT), PayPal, or manual card details sent via email or messaging apps. Any request to pay via these methods should be considered unauthorized and potentially fraudulent.
- Stripe Security: By entering your payment information, you authorize Stripe to process the transaction and apply advanced fraud detection protocols (including 3D Secure 2 and Stripe Radar). We do not store your full credit card details on our servers.
- Invoicing: All legal invoices/receipts are issued by Bed & Benacus Srl. The total price paid includes the local Sirmione Municipal Tourist Tax (Imposta di Soggiorno): no additional tax payment is required upon arrival for direct web bookings.
5. Refund Policy
In accordance with Art. 56 of the Italian Consumer Code (D.Lgs. 206/2005), all refunds are subject to the following conditions:
- Original Payment Method: Refunds will be issued exclusively to the same credit/debit card or payment instrument used to complete the initial reservation. For security reasons and to prevent money laundering, we cannot issue refunds to different cards, PayPal accounts, or via bank transfer.
- Processing Timeline: Once authorized, the refund is initiated immediately. However, the final credit to your account typically takes 3 to 5 working days, depending on the bank that issued your card and their internal processing times.
6. Cancellation Policy
For Direct Bookings (via this website):

In summary: You can cancel for free up to 14 days before your scheduled arrival. Cancellations made within the 14-day window preceding arrival, or "no-shows," are subject to a charge of 100% of the total booking amount.
For Third-Party Bookings: If you have booked via an online travel platform (Booking.com, Airbnb, Vrbo, etc.), the specific cancellation policy and payment terms of that platform apply. Any cancellation request or refund must be managed directly through the respective platform.
7. Mandatory Guest Registration (TULPS Art. 109)
Italian Public Security law requires all hosts to register guest data with the State Police via the Alloggiati Web portal. Approximately one week before check-in, we will send you an individual link to provide ID details for all guests.
Refusal of Stay: Under Art. 109 of the Consolidated Law on Public Security (TULPS), we are legally prohibited from accommodating guests who do not provide valid government-issued photo identification (Passport for non-EU or National ID for EU citizens). In accordance with current court practice (TAR Lazio 2025), digital identity verification must be completed before access to the property is granted. We reserve the right to refuse check-in without refund for any guest who fails to provide this mandatory information.
8. Driving, Parking and Shuttle Service
- The apartments are located within Sirmione historic center Zona a Traffico Limitato (ZTL). Driving into the historic center without specific municipal authorization results in automated fines issued via license plate recognition cameras. These fines remain the sole legal and financial responsibility of the vehicle operator.
- Parking: On request, we provide one complimentary reserved parking space at Grifo Parking (Piazzale Europa 5) from 12:00 on the day of arrival until 12:00 on the day of departure.
- Arrival/Departure Shuttle: A complimentary electric shuttle for guests and luggage operates between Grifo Parking and the property by reservation between 08:00 and 21:00.
- Pedestrianization Notice: On Sundays between June and September and on major public holidays, the historic center of Sirmione is fully pedestrianized between 14:00 and 19:00. During these windows, vehicular transit is strictly prohibited, and the shuttle service is the only authorized method for reaching the suites.
- Parking usage: After reservation we will send you a QR code to open Grifo Parking gate. You can leave and enter Grifo Parking at any time and as many times as you wish during your stay.
9. Arrival and Departure
- Check-in: Available from 15:00 to 00:00 on the day of arrival. Completion of payment and submission of identity documents are mandatory prior to receiving access codes to the apartments.
- Check-out: By 11:00 on the day of departure.
10. House Rules and Prohibited Conduct
- Quiet Hours: To ensure the peace of the residential building, guests must be respectful and keep noise to a minimum between 22:00 at night and 9:00 in the morning, as well as between 13:00 and 16:00.
- Pets: Small pets are welcome for an additional fee of €50 per booking. Service animals are exempt from this fee.
- Prohibited: Parties, events, smoking and throwing ash inside the apartment or the house grounds are strictly forbidden. Breach of these rules may lead to immediate termination of the stay without refund.
- Liability: Guests are liable for any damage caused to the property or its contents. We strongly recommend that guests maintain their own travel and liability insurance.
11. Seasonal Pool
A seasonal pool is available for guest use between 15 April and 1 October, from 9:00 to 20:00. Guests must adhere to the following rules and safety regulations:
- The pool area is provided without supervision and there is no lifeguard on duty. Use of the facility is strictly at the guests' own risk; all users are required to exercise maximum caution and ensure respectful behavior to ensure safety and comfort for all residents.
- Children under 14 years old must be supervised by adults at all times.
- Jumping into the pool is strictly prohibited.
- Animals are not allowed in the pool area.
- Please close sun umbrellas and return sun beds to their original positions before leaving the pool area.
12. Amenities, Housekeeping and Maintenance
- Availability of Amenities: We provide the amenities listed in our property descriptions. However, we cannot guarantee the uninterrupted availability of all features (e.g., specific appliances, WiFi, pool access) due to maintenance requirements or technical failures beyond our control. In such cases, we will act in good faith to restore service promptly, but the Host cannot be held financially liable for temporary interruptions that do not appreciably diminish the fitness of the property for residential use, in accordance with Art. 1578 and 1581 of the Italian Civil Code.
- Traveling with small children: baby beds and high chairs are available free of charge upon request.
- Standard housekeeping is included after the third night of your stay. Additional cleaning requested prior to this schedule is available for an extra fee. Guests are expected to treat the property with care and follow local waste separation guidelines as posted in the apartment.
13. Internet and WiFi Use
We provide free WiFi access for your convenience. However, the Host cannot be held responsible for service interruptions or slow speeds beyond our control. Guests are required to use the internet service lawfully and respectfully.
14. Governing Law and Jurisdiction
This agreement is governed by the laws of Italy. Any disputes shall be subject to the jurisdiction of the Courts of Brescia, Italy, without prejudice to the mandatory consumer protection laws of the guest's country of residence where applicable.

1. Introduction and Data Controllers
We take your privacy seriously. This policy explains how we collect, use, and protect your personal data. The processing of your data is carried out jointly by:
- The Owner: Andrey Semin, a natural person resident in Munich, Germany.

The Owner manages the digital platform and the booking contract, while the Management partner handles on-site operations, guest reception, mandatory public security registration, and financial invoicing. We comply with the EU General Data Protection Regulation (GDPR) and the Italian Personal Data Protection Code.
Legal Note: As the operator is based in Germany, this website also maintains a mandatory Impressum in accordance with § 5 of the Digitale-Dienste-Gesetz (DDG), available on this page and linked in our footer on every page.

3. Data Sharing and Financial Flow
To facilitate your stay, data is shared between the Owner and Management as follows:
- Operational Sharing: Guest names, contact details, and ID documents are shared with Bed & Benacus Srl to perform check-in services and comply with Italian law (TULPS Art. 109).
- Financial Flow: When you provide payment details via Stripe, your data is processed securely and shared with Bed & Benacus Srl for the purpose of issuing your legal VAT invoice and settling the transaction. The Owners do not have access to your full credit card details.
4. Third-Party Data Processors
We use trusted third-party services that process data on our behalf under Data Processing Agreements (DPA):
- Smoobu: Our core reservation system. It processes all booking data and guest communications.
- Stripe: Processes payments and provides advanced fraud detection.
- Cloudflare & hCaptcha: Provide edge security and bot protection to ensure site stability and secure form submissions.
- Google Services (GA4, Ads, Maps): These are only active if you grant consent. GA4 uses "Consent Mode v2" to honor your choices; if you reject tracking, only anonymous "cookieless pings" are sent to Google for aggregate modeling.
5. International Data Transfers
Some of our processors (Google, Stripe, Cloudflare) operate globally. When data is transferred outside the European Economic Area (EEA), we ensure it is protected via the EU-U.S. Data Privacy Framework or Standard Contractual Clauses (SCCs) approved by the European Commission.
6. Data Retention
We retain personal data only as long as necessary:
- Police Registration Data: Digital receipts of your Schedina Alloggiati are kept for 5 years as required by Italian law.
- Tax & Invoicing: Financial records and invoices issued by Management are retained for 10 years for Italian and German tax compliance.
- Analytics Data: Google Analytics data is set to expire after 14 months.
7. Your Rights
Under the GDPR (and CCPA/CPRA for our Californian guests), you have the following rights:
- Access & Portability: Request a copy of your data in a machine-readable format.
